Committee members considered two bills submitted by the Cabinet of Ministers and the people’s deputy of Ukraine A.Yatseniuk respectively.
The bill (Reg. No.11289), submitted by the Cabinet of Ministers of Ukraine, stipulates granting amnesty and extending it, first of all to those categories of convicted, who committed minor offenses, or are the most socially unprotected and vulnerable, particularly: minors, sick and elderly people, as well as persons who have children under the age of 18, or patients with cancer or tuberculosis, etc.
If this provision of the law is applied, 1,5 thousands of people of the abovementioned categories will be set at liberty.
The alternative bill (Reg. No. 11289-1), submitted by the people’s deputy A.Yatseniuk, suggests determining legal basis to set people free under the act of amnesty, as well as determining the mechanism of cooperation between penitentiary service and bodies of state authority, as well as local self-government bodies.
The bill stipulates applying amnesty to individually uncertain, but clearly defined, according to formal features, categories of persons.
The bill suggests applying amnesty and extending it, first of all, to the most socially unprotected and vulnerable categories of convicted, particularly: minors, pregnant, elderly people, and disabled, etc.
The document reduces the list of crimes, commitment of which prevents application of amnesty.
Final provisions of the bill suggest amending Criminal and Criminal Procedure Codes, as well as the Law “On Application of Amnesty in Ukraine”.
Having analyzed both bills, Committee members took the decision to recommend the Parliament adopt as basis the governmental bill.
People’s deputies recommend also take into consideration conclusions of the Central Scientific Experts Office of the Verkhovna Rada of Ukraine Secretariat.
